1. Agreement to Terms
WamPrepAI (“WamPrepAI”, “we”, “us”, or “our”) is operated by Wambri Group Limited, a company incorporated under the laws of the Republic of Kenya. These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “your”, or “user”) and WamPrepAI governing your access to and use of the website, application, and related services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility
The Service is intended for use by individuals who are at least 18 years old and who have the legal capacity to enter into a binding contract under the Kenyan Law of Contract Act (Cap 23) and the Age of Majority Act (Cap 33). By using the Service, you represent and warrant that you meet this requirement. We do not knowingly permit use of the Service by anyone under the age of 18, and we may suspend or terminate any account we reasonably believe belongs to a person under this age.
3. Description of the Service
WamPrepAI is an AI-powered interview preparation platform. The Service allows you to participate in voice-based mock interviews conducted by an AI interviewer, receive automatically generated scoring and feedback across multiple performance dimensions, and track your practice history over time. Interview questions and feedback are generated using artificial intelligence and are tailored to the role, industry, and experience level you select.
The Service is a practice and preparation tool. It is not a substitute for professional career counselling, recruitment services, or legal or employment advice, and it does not guarantee that you will pass any actual job interview, receive a job offer, or achieve any particular employment outcome. AI-generated feedback reflects automated analysis of your responses and may not always be fully accurate, complete, or applicable to every real-world interview scenario. You should exercise your own judgment when applying any feedback received through the Service.
4. Accounts and Registration
To access most features of the Service, you must create an account using a valid email address or an approved sign-in method. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at help@wamprepai.com if you become aware of any unauthorised use of your account.
5. Subscription Plans, Credits, and Payment
WamPrepAI offers a free tier and one or more paid subscription plans, which may be billed as a recurring subscription, a fixed-term credit allocation, or a one-off, pay-as-you-go purchase, as described on our Pricing page. Prices are listed and charged in Kenya Shillings (KES). We reserve the right to change our pricing and plan features at any time; changes will not affect credits or subscription time you have already paid for.
Paid plans are billed using M-Pesa, operated by Safaricom PLC. When you initiate a payment, you will receive an M-Pesa STK Push prompt on your registered phone number and must authorise the transaction using your M-Pesa PIN. We do not receive or store your M-Pesa PIN. Your plan or credits are activated automatically once Safaricom confirms your payment to us.
Free-tier usage, subscription credits, and unlimited-plan access are made available for a fixed period from the date of purchase or activation, as described on the Pricing page, and unused credits or access do not carry over once that period expires.
Refunds. Except as required by applicable Kenyan law, payments made for subscriptions or interview credits are non-refundable once a plan has been activated or a credit has been consumed (for example, once a mock interview session has started). Unactivated or unused purchases may be eligible for a refund at our discretion if you contact us at help@wamprepai.com promptly after payment. This clause does not affect any statutory right you may have under the Consumer Protection Act, 2012 in respect of a payment made for services never rendered or for services that are materially defective.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable Kenyan or international law, including the Computer Misuse and Cybercrimes Act, 2018;
- Gain or attempt to gain unauthorised access to our systems, another user's account, or any non-public part of the Service;
- Reverse engineer, decompile, scrape, or extract the underlying models, prompts, or source code powering the Service;
- Upload, submit, or transmit content that is unlawful, defamatory, obscene, hateful, or infringes the intellectual property or privacy rights of any third party;
- Interfere with, disrupt, or place an unreasonable load on the Service's infrastructure;
- Use the Service to build, train, or benchmark a competing product; or
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We may suspend or terminate your access to the Service, without refund, if we reasonably determine that you have violated this section.
7. Intellectual Property
The Service, including its software, design, branding, interview question logic, and underlying technology, is owned by WamPrepAI and its licensors and is protected by Kenyan and international intellectual property laws, including the Copyright Act (Cap 130) and the Trade Marks Act (Cap 506). Except for the limited licence to use the Service granted under these Terms, no rights are transferred to you.
You retain ownership of the content you submit through the Service, including your interview responses and voice recordings (“User Content”). By submitting User Content, you grant WamPrepAI a worldwide, non-exclusive, royalty-free licence to process, store, and analyse that content solely for the purpose of operating, maintaining, and improving the Service and generating your feedback, in accordance with our Privacy Policy.
8. Service Availability and Changes
We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. The Service depends on third-party infrastructure, including connectivity, cloud hosting, and voice and AI processing providers, and may be temporarily unavailable due to maintenance, technical issues, or factors outside our control. We may modify, suspend, or discontinue any feature of the Service, in whole or in part, at any time, with or without notice.
9. Disclaimer of Warranties
To the maximum extent permitted by Kenyan law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated feedback will be accurate, complete, or suitable for any particular interview or employment outcome. Nothing in this section limits any warranty that cannot lawfully be excluded under the Consumer Protection Act, 2012.
10. Limitation of Liability
To the maximum extent permitted by law, WamPrepAI, Wambri Group Limited, and their directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, opportunities, or data, arising out of or in connection with your use of, or inability to use, the Service — including any employment or interview outcome influenced by your use of the Service. Our total aggregate liability to you for any claim arising out of these Terms shall not exceed the total amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited or excluded under Kenyan law, including liability for death, personal injury, or fraud caused by our negligence.
11. Indemnification
You agree to indemnify and hold harmless WamPrepAI and Wambri Group Limited from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your User Content, or your misuse of the Service.
12. Termination
You may stop using the Service and request deletion of your account at any time by contacting help@wamprepai.com. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service. Provisions of these Terms that by their nature should survive termination (including Sections 7, 9, 10, 11, and 13) will survive.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or the Service shall first be addressed by contacting us at help@wamprepai.com to seek an amicable resolution. If the dispute is not resolved within thirty (30) days, it shall be subject to the exclusive jurisdiction of the courts of Kenya, without prejudice to either party's right to refer the dispute to arbitration under the Arbitration Act, 1995, by mutual agreement.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service or applicable law. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WamPrepAI regarding the Service.
